Australia Student Visa Changes from 2 October 2026: Who Must Apply Offshore?

Published 19 October 2026 · Reviewed 20 October 2026

From 2 October 2026, certain temporary visa holders must apply for Australian Student (subclass 500) and Student Guardian (subclass 590) visas from outside Australia under LIN 26/102, subject to applicable exemptions.

New Australian migration rules affect where certain temporary visa holders can apply for Student (subclass 500) and Student Guardian (subclass 590) visas.

From 2 October 2026, most temporary visa holders can no longer apply for these visas while they are in Australia. The changes also affect current Student visa holders applying for another Student visa, and the rules governing family members included in Student visa applications.

The changes are part of the Australian Government's student visa reforms, introduced to strengthen the integrity of the student visa program and address visa hopping.

The Migration (Student Visa Applications to Be Made from outside Australia) Instrument 2026 (LIN 26/102) specifies the visa subclasses and streams that require applicants to apply from outside Australia.

Which visa holders are affected? Under LIN 26/102, the offshore application requirement applies to holders of the following visa subclasses who meet the specific conditions set out in the instrument.

Visa subclass Visa name 400 Temporary Work (Short Stay Specialist) 403 Temporary Work (International Relations) — Domestic Worker (Diplomatic or Consular) stream only 407 Training

408 Temporary Activity

417 Working Holiday 457 Temporary Work (Skilled)

462 Work and Holiday

482 Skills in Demand

482 Temporary Skill Shortage

485 Temporary Graduate

600 Visitor 601 Electronic Travel Authority

602 Medical Treatment

651 eVisitor

771 Transit

988 Maritime Crew

995 Diplomatic (Temporary) — where the visa was granted under the specified criteria in Division 995.2

The list includes both current and legacy visa subclasses. Forsubclass 403, the instrument applies specifically to the Domestic Worker (Diplomatic or Consular) stream. For subclass 995, a further condition relating to the criteria under which the visa was granted applies.

Visa holders should confirm their exact subclass and, where relevant, their stream before making plans to lodge an application.

Can you still apply for a Student visa while in Australia? The answer depends on your current visa and circumstances.

The new rules restrict onshore applications for specified temporary visa holders. They also affect current Student visa holders who want to apply for another Student visa while remaining in Australia.

Some current Student visa holders may qualify for an exemption, including certain applicants who: Need up to 12 additional months to complete their main course with the same education provider. Are sponsored by the Department of Foreign Affairs and Trade (DFAT) or the Australian Department of Defence. Are applying to undertake a PhD. Are applying for primary or secondary school studies. Have completed a course and are progressing to an eligible higher-level course. Cannot continue their course because their education provider has defaulted. These exemptions are subject to specific requirements. They do not automatically apply to everyone who holds a Student visa or is enrolled in an Australian education provider. Current Student Guardian visa holders can continue to lodge a further Student Guardian visa application while in Australia, provided they meet the applicable visa requirements. Before lodging, applicants should check the current eligibility criteria published by the Department of Home Affairs.

What happens if you must apply offshore? If the rules require you to apply from outside Australia, you must be outside the country when you lodge your application. You must also be outside Australia when the visa is granted.

If you lodge an application in Australia when you are required to apply offshore, your application will be invalid.

An invalid application can have serious consequences, particularly if your current visa expires before you take appropriate action.

If you apply from outside Australia, you may be able to return on another valid visa while your Student visa application is being processed. However, you must be outside Australia when the Student visa is granted, and you will not receive a Bridging visa linked to the offshore application.

Applicants should not assume that leaving Australia automatically extends their existing visa or guarantees approval of a new visa.

What about family members and dependants? The October 2026 reforms also change the rules for including family members in Student visa applications.

Student visa applicants can generally no longer include their partner or dependent children unless an exemption applies. Eligible exemptions include certain students undertaking PhD studies, DFAT- or Defence-sponsored students, recipients of qualifying foreign government scholarships, and eligible students from Pacific countries or ASEAN member countries.

Separate restrictions apply to adding family members as subsequent entrants after a Student visa has been granted.

These family-member provisions are separate from the offshore application rules under LIN 26/102. Applicants should check both sets of requirements before deciding how to proceed.

What about Student visa applications lodged before 2 October 2026? Student visa applications lodged before 2 October 2026, including applications that included family members, continue to be assessed under the rules that applied when they were lodged.

The new requirements apply to applications made on or after the commencement date. Anyone preparing a new application should check the current rules rather than rely on the requirements that applied to an earlier application.

What should international students do now? If you are currently in Australia and considering a Student or Student Guardian visa application, take the following steps before making decisions about study, travel or further visa applications:

1. Check your current visa. Confirm the subclass and any relevant stream. 2. Confirm where you can apply. Determine whether the new rules require you to lodge offshore. 3. Check for exemptions. Do not assume an exemption applies without meeting the relevant criteria. 4. Review your visa expiry date. Make sure you understand your current visa conditions and available options. 5. Check the family-member rules. If you intend to include a partner or dependent child, confirm whether an exemption is available. 6. Seek appropriate advice. Consider a consultation with a Registered Migration Agent before making significant financial, travel or enrollment commitments.

How EMC Australia can help Australia's student visa rules can be complex, particularly for temporary visa holders already in the country who are considering a change of study plans or a further visa application.

EMC Australia can help you arrange a consultation with a Registered Migration Agent to discuss your circumstances, understand the relevant requirements and identify the appropriate next steps.
