If a visa or citizenship was refused or cancelled
A refusal or cancellation is not the end of every matter. It is also not an automatic second try. The first job is to read the decision, the original application, and the deadline — then choose a tribunal review, a new application, a court review, or none of those.

A tribunal review is not a new visa application. Time limits are short.

The Department refused a visa and you still have time to apply to the Administrative Review Tribunal.
The tribunal looks at the matter again, including new evidence in many cases. Deadlines are short — often 21 or 28 days from the decision, sometimes less.

Tribunal review — visa cancellation
A visa was cancelled and you have review rights.
Cancellation reviews are different from refusal reviews. Character cancellations need evidence about rehabilitation, family and risk — not a partner-visa photo album.

Citizenship by conferral, descent or evidence was refused or cancelled, and the decision can be reviewed.
Citizenship reviews are not visa reviews. The type of citizenship application (conferral, descent, evidence) is still the heading.

Tribunal review — nomination or sponsorship
The Department refused a nomination or a sponsorship (for example 482, 186, 494 or 407), and there are still review rights.
This is not the same as the visa refusal. Deadlines are still short.

You say the Department or the tribunal made a legal error — not merely that you disagree with the outcome.
The court does not re-weigh the relationship or the points test. It looks at whether the law was applied lawfully. Time limits are strict. This is lawyer work; we work with Australian legal practitioners when a matter needs the court.

Things that go wrong
- Review periods are counted in days, not months. Do not wait for a convenient week.
- Lodging a new visa instead of a review can be right or disastrous. It depends on the decision.
- Not every refusal can be reviewed. Some have no tribunal rights.
- Court is not a chance to add more photos of the relationship.
