**8105 – Work Restriction:**

 

This condition stipulates the limitations and permissions related to work for individuals holding a student visa in Australia.

– You are not allowed to engage in any form of work in Australia before the commencement of your course of study, unless you were already holding a visa that permitted you to work in the country at the time of applying for the student visa.

– During the periods when your course of study or training is in session, you are restricted to working a maximum of 48 hours per fortnight (a two-week period). This includes both paid and unpaid work.

– However, there are exceptions to this limitation:

  – If your course requires specific work as part of its curriculum and this work is officially documented in the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) at the time of your course enrollment.

  – If you hold a student visa granted for a master’s by research or doctoral degree, and you have commenced your research or doctoral program.

– The term “fortnight” refers to a period of 14 days that starts on a Monday.

– On 9 May 2023, temporary changes were implemented, exempting student visa holders working in the aged care sector from the 48-hour fortnightly work restriction. This exemption is solely applicable to work within the aged care sector and will conclude on 31 December 2023.

 

**8202 – Meet Course Requirements:**

 

This condition outlines the obligations associated with maintaining enrollment and satisfactory progress in your registered course.

– You are required to stay enrolled in a course that is registered with the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS). If you are sponsored by Foreign Affairs or Defence or are a secondary exchange student, maintaining full-time enrollment in your course is mandatory.

– You must continue to be enrolled in a registered course that is at the same or higher Australian Qualifications Framework (AQF) level for which your student visa was granted. The exception to this rule is when changing from an AQF level 10 to level 9 course. This ensures you are pursuing education consistent with your visa grant.

– Maintaining regular attendance and making satisfactory progress during each study period, as required by your education provider, is essential.

 

**8208 – No Study Change Related to Critical Technology without Approval:**

 

This condition involves obtaining approval from the Minister for Home Affairs before undertaking certain types of study.

– As of now, there are no specified technologies considered critical under this condition. Therefore, if your visa is subject to condition 8208, you are not required to take any specific actions to comply at the moment.

– The condition will be updated once specific categories of critical technology are defined. At that point, if your visa is subject to this condition, you will need to follow the outlined guidelines for requesting approval to change your course of study related to critical technology.

– This condition aims to regulate studies related to critical technology, which may include postgraduate research courses, theses or research topics, and certain bridging courses. The Minister’s approval is necessary to ensure that the study doesn’t pose an unreasonable risk of transferring critical technology.

 

**8501 – Maintain Adequate Health Insurance:**

 

This condition emphasizes the necessity of having and maintaining appropriate health insurance for the entire duration of your stay in Australia.

– You are responsible for obtaining and retaining health insurance coverage that adequately meets your health needs while you are in Australia. This ensures that you have access to medical services as needed.

**8516 – Continue to Satisfy the Criteria for the Grant of the Visa:**

 

This condition requires you to uphold the criteria that were used to grant you the student visa.

**8517 – Maintain Adequate Arrangements for the Education of Your School-Age Dependents:**

 

This condition pertains to ensuring suitable education arrangements for dependents of school age who are accompanying you on your visa.

– If you have school-age dependents (children of compulsory school age) staying in Australia as your dependents for more than 3 months, you are obligated to have appropriate plans in place to provide them with adequate education.

– This requirement is in place to ensure that school-age dependents have access to proper education during their stay in Australia.

 

**8532 – Maintaining Welfare Arrangements for Minors:**

 

This condition focuses on the well-being and care of individuals under 18 years of age who are on a student visa.

– If you are younger than 18 years of age, you must have appropriate accommodation and support, ensuring your general welfare is maintained throughout your stay.

– There are specific options for maintaining welfare, including staying with a parent, legal custodian, or an approved nominated relative who is over 21 and of good character. Alternatively, approved accommodation, support, and welfare arrangements can be set up through your education provider.

– Changes to your welfare arrangements require written approval from your education provider. You are not permitted to travel to Australia until these approved welfare arrangements are in effect.

– Specific information about this condition is provided for different visa categories, such as 570-576 and 500 visa holders.

 

**8533 – Inform Provider of Address:**

 

This condition involves updating your residential address and education provider information.

– If you were outside Australia when your visa was granted, you must inform your education provider of your residential address within 7 days of arriving in Australia.

– If your residential address changes while you are in Australia, you are required to notify your education provider within 7 days of the change.

– If you change your education provider, you must notify your current provider within 7 days of receiving confirmation of enrollment or evidence of enrollment from the new education provider.
