Australia’s migration system continues to evolve in 2026, with new Student visa application rules and updated processing priorities for certain skilled visa applications. These changes may affect international students, families planning to study in Australia, and skilled workers exploring opportunities.
If you are planning to apply for an Australian visa, understanding the latest rules can help you prepare and explore the pathway that best suits your circumstances.
1. New Student Visa Rules Effective 2 October 2026
From 2 October 2026, new rules apply to Student visas (subclass 500) and Student Guardian visas (subclass 590).
Most Student visa applicants must now lodge their applications from outside Australia unless they meet the applicable requirements for applying onshore. Additional restrictions apply to current Student visa holders who want to apply for another Student visa while in Australia.
Applicants should check their current visa status and the relevant exemption criteria before making plans to continue their studies or lodge another application.
Applications lodged before 2 October 2026 generally continue to be assessed under the rules that applied when they were lodged.
2. Changes to Bringing Family Members to Australia
The new rules also restrict the inclusion of family members, such as a partner or dependent child, in Student visa applications.
Exemptions may apply to eligible doctoral students, nationals of eligible ASEAN and Pacific countries, certain fully funded foreign government scholarship recipients, and students sponsored by Australia's Department of Foreign Affairs and Trade or Department of Defence.
The Philippines is an ASEAN member country and is included in the nationality-based exemption category for family inclusion. However, applicants must still meet the applicable requirements, and this exemption does not guarantee visa approval.
Important: Family members cannot apply later as subsequent entrants to join a Student visa holder under the new rules. There are no exemptions to this restriction. Student visa holders also cannot add family members after their visa has been granted.
If you are planning to study in Australia with your family, check the current requirements before lodging your application.
3. Updated Skilled Visa Processing Priorities
From 19 September 2026, Ministerial Directions 121 and 122 introduced updated processing priorities for certain Australian skilled visa applications, replacing the previous priorities under Ministerial Direction 119.
Priority areas include applications relating to:
- Construction - Healthcare - Teaching - Agriculture, aquaculture and fishing - Resources - Australia's law enforcement and defence interests
The directions also establish different processing priorities based on visa category and, in some cases, whether the applicant was in Australia or overseas when the application was lodged.
These directions cover specified temporary, permanent and provisional skilled visa subclasses. They do not apply to every Australian visa.
Important: Processing priority is not the same as visa eligibility or approval. Applicants must still satisfy the requirements of their chosen visa subclass.
4. What Should Applicants Do Next?
Before lodging an Australian visa application, consider the following steps:
- Check the latest requirements on the official Department of Home Affairs website. - Confirm whether your current visa allows you to apply in Australia. - Review the rules for including family members, if applicable. - Check whether your occupation and circumstances align with a relevant skilled visa pathway. - Seek professional advice if you have a previous refusal, cancellation, complicated visa history or uncertainty about your options.
Immigration rules can change, and the right pathway depends on each applicant's circumstances. Avoid relying on social media posts alone when making important visa decisions.
