This Privacy Policy explains how EMC Australia collects, uses, stores and discloses personal information when you use our website, contact us, or submit an enquiry through Facebook, Instagram or other Meta lead forms (including Instant Forms / Lead Ads).

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and (where relevant) the Spam Act 2003 (Cth).

1. Who we are

EMC Australia is an education and migration consultancy. We provide immigration, education and related services. Our Registered Migration Agent details include MARN 1800335.

2. What personal information we collect

Depending on how you contact us, we may collect:

  • Name
  • Email address
  • Phone number (including WhatsApp or similar messaging numbers)
  • Country of residence or location
  • Visa interest or visa subclass (for example Partner Visa 820/309)
  • Other details you choose to provide in a form, message or consultation (such as relationship status, current visa, occupation, or questions about eligibility)
  • Technical data from our website (IP address, device/browser type, pages viewed, cookies or similar technologies)

We do not ask you, through a Meta Instant Form, to upload identity documents. If you later become a client, we may collect additional information needed to assess or lodge a visa or education matter. That information is handled for the purpose of providing those services.

When you submit a Meta lead form, Meta (Facebook/Instagram) collects the information you enter and provides it to EMC Australia so we can respond to your enquiry. Meta also has its own privacy policy, which applies to how Meta handles your data.

4. Why we collect it (purposes)

We use personal information to:

  • Respond to your enquiry and contact you about the visa or education pathway you asked about
  • Assess, at a preliminary level, whether we can assist you
  • Book a consultation or follow up by phone, email, SMS or WhatsApp
  • Provide migration, education or related services if you engage us
  • Meet our professional, legal and record-keeping obligations
  • Improve our website, advertising and services
  • Comply with Australian law

If you submit a Partner Visa (or other visa) lead form, we use the details you provide to contact you about that enquiry. We do not sell your personal information.

5. Direct marketing and lead ads

If you submit a lead form or tick that you want to hear from us, we may contact you about EMC services related to your enquiry. You can opt out of marketing messages at any time by telling us (reply “stop”, use an unsubscribe link, or email us). Opting out of marketing does not stop us contacting you where we must do so for a service you have asked us to provide, or where the law requires it.

6. Who we disclose information to

We may share personal information with:

  • EMC staff and contractors who need it to handle your enquiry or matter
  • Our professional advisers (for example lawyers or IT providers) under confidentiality arrangements
  • Service providers who host our website, email, CRM or advertising tools (including Meta, if you used a Meta form)
  • Government agencies (such as the Department of Home Affairs) where you instruct us to lodge an application, or where the law requires disclosure

Some providers may store or process information outside Australia. We take reasonable steps to ensure they handle it consistently with this policy and Australian privacy law.

7. Storage and security

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. No method of transmission or storage is completely secure. Please do not send highly sensitive documents through a social-media lead form.

8. How long we keep information

We keep personal information only as long as we need it for the purposes above, or as required by law and professional obligations (migration files may need to be retained for several years). We then take reasonable steps to destroy or de-identify it.

9. Access, correction and complaints

If you are unhappy with how we have handled your information, please contact us first. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC): oaic.gov.au.

10. Children

Our lead forms and website are intended for people who can make an enquiry about education or migration services. We do not knowingly collect personal information from children through Meta Instant Forms for the purpose of those ads. If you believe we have collected a child’s information in error, contact us and we will take reasonable steps to delete it.

11. Cookies and analytics

Our website may use cookies, pixels or similar tools (including Meta/Facebook pixels) to understand site use and to measure or improve advertising. You can control cookies through your browser and, where offered, our cookie settings. Blocking cookies may affect some site features.
